Sukeban Creative (henceforth referred to as “sukeban creative,” “us,” and “we” interchangeably) operates www.sukebancreative.com (referred to as “the website,” “our website,” “our site” and “the site” interchangeably).
By visiting our website and/or purchasing something from us, are agreeing to be bound by the following Terms and Conditions (also referred to as “terms of service” and “terms” interchangeably). These terms apply to all users of and visitors to the site. By accessing the site or making a purchase, you agree to be bound by these terms of service. If you do not agree to all the Terms and Conditions outlined below, then you may not access the website or use any services. Please read these Terms and Conditions carefully before accessing our website or making a purchase.
We reserve the right to refuse service to anyone for any reason at any time without notice. Use of the website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
We also reserve the right to change or modify these Terms and Conditions at any time without prior notice. Please review it frequently. Any changes to these terms are effective immediately upon being posted to the website. We will update you here when changes have been made. If you visit or access the website after these changes, are accepting these changes and are bound by the revised terms.
Sukeban creative designs, product combinations, layouts and packaging are the sole intellectual property of sukeban creative. Gifts may not be imitated, duplicated, or purchased and then altered in any way while still being presented as a sukeban creative product.
We reserve the right to include a business card or identifying sticker within each gift box. We also reserve the right to publish images of finished products on social media, and for those images to be shared and used for our marketing purposes.
Sukeban creative and our photographers do our best to accurately photograph and describe our gift boxes and their contents. Occasionally, manufacturers will update their products and/or packaging. We will do our best to have these changes reflected on our site, but we ask that the client and the end user read ingredient labels, warnings, and directions. We are not liable for manufacturer changes or defect in the products in our gift boxes. We ask that you contact the product manufacturer directly with any questions or concerns.
Similarly, we take allergy issues very seriously. If you need an item substituted because of an allergy, please notify us in the ‘Additional Information/Special Instructions’ entry box of your order form. Most food products will be labeled with allergy information as provided by the manufacturer. Any questions or concerns about these products should be discussed with the manufacturer directly. Any non-labeled food product runs the risk of potential allergens or cross contamination. Clients and end-users are encouraged to research these products and take caution before consuming them. Sukeban Creative cannot be held liable for adverse reactions related to the consumption of an allergen contained in a food product.
At sukeban creative, we scout out and curate the optimal products for our gift boxes. We often work with small business and local makers. For that reason, and because of other potential and/or unforeseen supply issues, we reserve the right to to substitute a product when necessary. That substitution will be of the same type and quality, of equal or greater value, and as close to the original as possible. If an equivalent substitution cannot be found, or if the product is especially unique, we will reach out to you about a replacement item or discount the gift box by the value of that item.
At this time, sukeban creative delivers within the United States only. We are working to expand our shipping to other locations… stay tuned!
The client must provide correct shipping information. We cannot be held responsible for delays, added fees, deliveries to the wrong address or returns due to errors in shipping/delivery information. If an item is returned to us due to incorrect shipping information, we will have to charge for any fees assessed to us and an additional shipping fee to resend the item. We cannot provide a refund on delivery or shipping charges. We are not responsible for packages unclaimed from shipping carriers. If a package is returned to us because it was left unclaimed, we can arrange to have the gift sent to an alternate address for an additional charge. We cannot issue refunds due to a package being left unclaimed with a carrier.
Sukeban creative orders will be deemed to have taken place at the time they are put in the possession of a carrier service (UPS, USPS, or FedEx) for customer delivery. We are not responsible for lost, stolen or damaged goods once an order leaves our possession. Please notify us of products damaged in transit within 48 hours of delivery. Please keep original packing material and send us a clear image of the damage to contact@sukebancreative.com so that we may file a claim with the carrier.
Items that are picked up or hand delivered are likewise deemed to be delivered when put in the possession of the client or a client approved third-party (family member, venue staff, event planner, hotel, etc). We are not responsible for items that are improperly delivered, damaged, lost or stolen while in the possession of the client or the client approved third-party.
During summer months or when shipping to especially warm locations, we reserve the right to swap out items that are subject to melting and/or heat related damage with comparable items. We will contact you via the contact information provided to notify you of these changes to the gift box. Please note that we cannot always control the temperature of items during transit and delivery and ordering items subject to melting or freezing is at your own risk. We cannot issue refunds as a result of temperature related damage, regardless of the time of year.
All customizable items (personalized gift messaging, gift tags, labels, stickers, etc) included as part of an order will be printed exactly as they are submitted by the customer. It is the customer’s sole responsibility to ensure that all submissions are correct and without error. We are not responsible for any misspellings, typographical errors or any other inaccuracies due to client error. Once artwork is approved by the client, we are no longer responsible for any errors, so please check proofs carefully.
Sukeban creative does not claim ownership of the materials you provide to us including suggestions, ideas, proposals, or other materials (collectively referred to as “submissions”), that are emailed, uploaded commented, messaged or otherwise submitted to us in any manner. However, by providing us with your submission, you are granting us and our associates permission and the right to use your submission in connection with the operation of our businesses including, to edit, copy, publish, distribute, translate and otherwise use in any medium without restriction. You are also granting us access to publish your name in connection with your submission. Sukeban creative is under no obligation to respond to submissions or keep any them in confidence. No compensation will be paid with respect to the use of your submission, as provided herein. We are under no obligation to post or use any submission you may provide and may remove any submission at any time at our sole discretion. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit to us.
Sukeban creative may, but has no obligation to monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these our own Terms and Conditions. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
Please know that any comments, feedback, emails, messages, suggestions or other communications sent to sukeban creative, and our social media platforms, shall be and remain the exclusive property of sukeban creative. All images and documents designed on and/or uploaded to our website shall be and remain our exclusive property. Your submission of any such comments or submissions shall constitute an assignment to sukeban creative of all worldwide rights, titles and interests in all copyrights and other intellectual property rights. Sukeban creative will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way.
Prices for our products and services are subject to change without notice. New prices will be updated on the site and are effective immediately. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We reserve the right at any time after receipt of your order to accept or decline your order for any reason.
Other than as set out in these Terms and Conditions, we shall not be responsible for any loss or damage of any kind, which you might suffer by reason of us declining to accept or for cancelling your order.
